CreatiVista Service makes no warranties or representations, whether express or implied, regarding the operation, content, materials, or products available through the services, including the accuracy or timeliness of the content. To the fullest extent permitted by law, CreatiVista Service disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, and that access to or use of the services will be secure, uninterrupted, or error-free.
LIMITATION OF LIABILITY
Under no circumstances shall CreatiVista Service (Orchid), its affiliates, vendors, subcontractors, officers, directors, employees, or agents be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, business interruption, loss of data, or costs of replacement goods arising from this agreement, use or inability to use the services, or reliance on any content, even if CreatiVista Service has been advised of the possibility of such damages.
Miscellaneous
CreatiVista Service (Orchid) reserves the right to terminate or suspend your access to the services at any time, without prior notice or liability, if you violate this agreement or for any other reason. Failure by either party to enforce any right under this agreement shall not be considered a waiver of future rights. This agreement is non-transferable, non-assignable, and cannot be sublicensed by you without prior written consent from CreatiVista Service.
